1. Introduction
These Terms of Use ("Terms") are an agreement between you and the operator of Exterminator Says (the "Site," "we," "us"). They govern your use of the Site, including the bug identifier, the pest guides, the seasonal home map, and the free inspection request form (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use it.
The Site is independently run. It is not itself a pest control company and does not perform pest control services.
2. Important Disclaimer; No Reliance

- Do not rely on the Service to make decisions about your health, safety, property, structural damage, treatments, pesticide use, or purchases. Pest products can be hazardous; always follow the product label and local regulations, and consult a licensed professional when in doubt.

3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service or submit an inspection request. You agree to use the Service only in compliance with applicable law.

Our Privacy Policy explains how we handle information and is part of these Terms. If we post additional rules for a feature, they also apply to that feature.
5. Changes to These Terms
We may change these Terms at any time by posting the updated version with a new "Last updated" date. Your continued use of the Service after a change means you accept the revised Terms. If you do not agree, stop using the Service.
6. License to Use the Service
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own personal, non-commercial purposes.

- submit false, misleading, or someone else's information in an inspection request, or submit requests for a person who has not agreed to be contacted;
- upload photos that contain people, sexually explicit or illegal content, or content you do not have the right to share;
- scrape, crawl, or harvest content or data from the Service by automated means, or resell or commercially exploit it;
- attempt to hack, probe, overload, or interfere with the Service, bypass rate limits or security, or introduce malware;
- misrepresent your identity or affiliation, or imply that we endorse you.
9. Your Content and Photos
When you upload a photo or enter text, you confirm that you have the right to do so. You give us a limited, non-exclusive license to transmit and process that content, including by sending it to our AI service provider, solely to provide you with the identification and to operate and protect the Service. We do not claim ownership of your photos and do not save them on our server (see the Privacy Policy).
10. Free Inspection Requests
The inspection request form lets you ask for a free inspection. By submitting a request, you confirm that the information is accurate, that you are authorized to request an inspection at the property, and that you consent to be contacted as described in the form and our Privacy Policy.
- We are not the service provider. We collect your request and pass it to a pest control company named on the form. Any inspection, estimate, treatment, contract, or pricing is a matter between you and that company and is governed by the company's own terms.
- We do not guarantee that you will be contacted within any particular time, that an inspection will be available at your location, or that any service will be offered or recommended.
- We are not responsible for the company's actions, advice, work, products, or prices.
11. Feedback
If you send us suggestions or feedback, you agree that we may use them without obligation or payment to you.
12. Third-Party Sites and Services
The Service may link to or rely on third-party websites and services, including our AI, hosting, and spreadsheet providers. We do not control them and are not responsible for their content, availability, or practices. Your dealings with any third party are solely between you and that party.
13. Communications
By giving us your email address or phone number, you agree that we, or the pest control company named on the form, may contact you about your request. You can ask us to stop at any time by emailing support@exterminatorsays.com. Notices to you may be given by email or by posting on the Site. Notices to us should be sent to the same email address.
14. Suspension and Termination
We may suspend or end your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if needed to protect the Service or others. You may stop using the Service at any time. Sections that by their nature should survive termination (including ownership, disclaimers, indemnification, limitation of liability, and governing law) will survive.

WE DO NOT WARRANT THAT ANY IDENTIFICATION, DANGER RATING, OR GUIDANCE IS CORRECT OR COMPLETE, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL MEET YOUR NEEDS. YOU USE THE SERVICE AT YOUR OWN RISK. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the operator of the Site and its contributors and service providers from claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or third party's rights.

BECAUSE THE SERVICE IS FREE, TO THE EXTENT ANY LIABILITY IS FOUND, OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow these limits, so they may not apply to you.
18. Governing Law and Disputes
These Terms are governed by the laws of the United States and the state in which the operator of the Site resides, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@exterminatorsays.com and try to resolve the issue informally for at least 30 days. Any claim that is not resolved will be brought in the state or federal courts located in that state, and you consent to their jurisdiction.

We respect the rights of others. If you believe content on the Site infringes your copyright, email support@exterminatorsays.com with: your contact information; a description of the work claimed to be infringed; the URL of the material on the Site; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your signature (typed is fine). We may remove material and, where appropriate, end access for repeat infringers.
20. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a sale or transfer of the Site. Nothing in these Terms creates a partnership, employment, or agency relationship. We are not liable for delays or failures caused by events beyond our reasonable control.
